Contract For Services

Summary of Contract: Wild Blossoms Studio is responsible for providing the client with the following documents: Contract, Payment Receipt (s) with services/products listed within, and our Welcome Document.

The client undertakes to engage Wild Blossoms Studio for this coverage for the price as detailed within this agreement and the other documents. This agreement, along with any Sub Agreements, contains the entire understanding between Wild Blossoms Studio and the Client.

Reservation of Services: To reserve the services of Wild Blossoms Studio, the contract must be acknowledged and the retainer paid.

Retainer: A non-refundable retainer of 50% is due with the signed contract. The retainer will be applied to your final balance.

Balance of Payment: The remaining balance can be paid in installments or a lump sum. Final payment is due upon completion of the project. Failure to pay promptly will be considered a termination of the contract, and no delivery will be made.

Payments Accepted: MasterCard, Visa, Discover, or AmEx.

Acceptance of Delivery: In the event the client is not available during the scheduled delivery, the client will designate someone to accept the delivery and be sure all items requested are accounted for and in good condition. Wild Blossoms Studio will not be held accountable if any items that become damaged or missing due to failure to meet with the delivery person. The client does hereby release from responsibility Wild Blossoms Studio in the event the client or designated person cannot be located or chooses to not be present for delivery.

Artistic License: Each art piece is created using the flowers from your event that look the best, have retained their color, and have interesting textures and shapes. We are NOT recreating your wedding bouquet. We use flowers from your bouquet to create a piece of pressed flower art in the spirit and color palette of your day. Wild Blossoms makes no guarantees of replication of any kind and each preservation art piece is open to the artistic vision of the designer. Depending on the quantity and quality of your flowers when they arrive at the studio, Wild Blossoms reserves the right to augment your art with matching flowers from our collection that coordinate with your color palette. If we need to order and press more flowers to create an heirloom art piece that is representative of the Wild Blossoms brand, we will add $50-75 depending on flower types to your final invoice.

Photo Release: By signing this contract, you expressly grant Wild Blossoms Studio permission to use photos of your art in various forms of advertising and promoting our services. Where images are provided by your contracted photographer, appropriate credit will be given. Wild Blossoms Studio may use and publish photographs of your art for editorial, trade, advertising, website use, or any other purpose and in any manner and medium that they see fit to promote Wild Blossoms Studio. Wild Blossoms Studio may, at our cost and discretion, document aspects of your project with photography, video and or written word with vendors of our choosing. This documentation is for our portfolio and proof of vendor delivery.

OTHER ITEMS:
Extreme conditions: Wild Blossoms’ busy wedding season is June-October and, while we can accept and press bouquets during that season, we do not design and complete art until November-May. Wild Blossoms Studio will make every possible effort to deliver items ordered on time. However, Wild Blossoms Studio shall not be liable for delay or the inability to deliver due to severe weather, traffic accidents, road closures, landslides, foods, or other acts of nature, pandemics, or war.

Incapacitation: In the event of the incapacitation of the designer a refund of monies paid will be issued.

Liability: Wild Blossoms Studio will at no time be liable for more than the amount the client has paid for the project contracted. In the event of a fire, natural disaster, tragedy, or other emergency, liability is limited to a refund of monies paid.

Responsibility: Wild Blossoms Studio’s responsibility for the care, quality, and/or longevity of all flowers and arrangements ends with the acceptance of possession by the client or their representative.

Indemnity: Wild Blossoms Studio is in no way liable or responsible for any injuries or accidents that may occur at the stated address.

Arbitration: Any dispute or difference arising out of or in connection with this contract shall be determined by the appointment of a single arbitrator to be agreed between the parties or failing agreement within fourteen days after either party has given to the other a written request to concur in the appointment of an arbitrator, by an arbitrator to be appointed by the President or a Vice President of the Chartered Institute of Arbitrators. Unpaid fees by the client shall be exempt from arbitration and settled via Small Claims Court or other appropriate means.
